1. Agreement to Terms

By accessing or using LLMWatch ("Service"), including the website at llmwatch.ai and the application at app.llmwatch.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

LLMWatch is a software-as-a-service platform that monitors how AI language models (e.g. ChatGPT, Claude, Gemini, Perplexity) describe brands and provides analytics and recommendations. The Service is provided on an "as is" and "as available" basis.

3. Account and Registration

You must provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Infringe on the intellectual property or privacy rights of others
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Use the Service to harass, abuse, or harm others
  • Resell, sublicense, or commercially exploit the Service without our written consent
  • Reverse engineer, decompile, or disassemble the Service (except as permitted by law)
  • Use automated means (e.g. bots, scrapers) to access the Service without our permission

We reserve the right to suspend or terminate your account for any violation of these Terms.

5. Intellectual Property

The Service, including its design, software, content, and trademarks, is owned by LLMWatch and protected by intellectual property laws. You do not acquire any ownership rights by using the Service. You retain ownership of content you submit; you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process such content solely to provide the Service.

6. Payment and Subscription

Paid plans are billed according to the pricing displayed at the time of purchase. Fees are non-refundable except as required by law or as explicitly stated in our refund policy. We may change pricing with reasonable notice; continued use after changes constitutes acceptance. You are responsible for any applicable taxes.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Results from AI monitoring may vary and are not guaranteed to be accurate or complete.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL LLMWATCH, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS.
  • OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
  • THE ABOVE LIMITATIONS APPLY WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless LLMWatch, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may terminate your account at any time through the account settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including Sections 5, 7, 8, 9, 11, 12) shall survive termination.

11. Modifications

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the European Union and the member state in which LLMWatch is established, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction.

13. General

  • Entire agreement: These Terms constitute the entire agreement between you and LLMWatch regarding the Service.
  • Severability: If any provision is held invalid, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
